By accessing or using Persona AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Persona AI is a SaaS platform that uses artificial intelligence to automate direct message conversations on social media platforms (Instagram, Fanvue) on your behalf. The bot operates using session cookies you provide and responds according to your configured persona.

3. Account Responsibilities

• You must be at least 18 years old to use the Service.
• You are responsible for maintaining the security of your account credentials.
• You are solely responsible for all activity conducted through your connected social media accounts.
• You must not use the Service to harass, spam, or deceive others in a harmful way.

4. Platform Compliance

Using automated messaging tools may violate the terms of service of third-party platforms such as Instagram and Fanvue. You acknowledge and accept all risks associated with using the Service, including the potential suspension of your social media accounts. Persona AI is not responsible for any actions taken by third-party platforms against your accounts.

5. Subscriptions and Billing

• Free tier accounts are subject to daily and monthly message limits.
• Pro subscriptions are billed monthly via Stripe.
• You may cancel your subscription at any time from the dashboard. Cancellation takes effect at the end of the current billing period.
• Refunds are handled on a case-by-case basis. Contact support for requests.

6. Acceptable Use

You agree not to:

• Use the Service to send unsolicited bulk messages or spam.
• Impersonate a real person without their consent.
• Use the Service for illegal activities or to distribute harmful content.
• Attempt to reverse-engineer, disassemble, or exploit the Service.
• Share your account access with unauthorized third parties.

7. Intellectual Property

The Service, including its design, code, and branding, is owned by Persona AI. You retain ownership of your persona configurations and message content. By using the Service, you grant us a limited license to process your data solely for the purpose of operating the bot on your behalf.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. Persona AI shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of social media accounts, loss of revenue, or data loss.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time from the Settings page, which will permanently remove all your data.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
